Valli Kane & Vagnini LLP (“VKV”) is currently investigating Equinox Holdings, Inc.’s (“Equinox”) failure to pay its Personal Trainers overtime pay for each and every hour worked in excess of forty (40) per week.
VKV is also investigating Equinox’s failure to pay its Personal Trainer’s “spread of hours” pay for each day worked in excess of ten (10) hours and its failure to issue the proper wage statements in accordance with the New York Labor Law. Specifically, VKV believes that Equinox paid its Personal Trainers on a “per training session” basis, which did not account for overtime hours or for “spread of hours.”
If proven true, this pay practice is in violation of both the Fair Labor Standards Act and the New York Labor Law and the Personal Trainers could be entitled to unpaid overtime wages, unpaid spread of hours pay, wage statement penalties, and liquidated damages.
